Snow and Ice Cases
Tis the season for snow and ice cases. During this time of year people are injured by slipping and falling due to snow and 'black ice'. In NY courts have held that while a storm is in progress a property owner cannot be held liable for snow or ice injuries. An injured party has to show that the property owner had a reasonable amount of time to shovel the snow or salt the ice in front of his premises. Alternatively, an injured party also has to show that the property owner created a dangerous condition.
