What You Need To Know if You Were Hurt in a Mass Transit Accident

1. If you were injured in a mass transit accident, you need to determine if the party at fault was a private company or a government agency, such as the MTA, Staten Island Ferry, Bee Line Bus, or other public transportation service. This is important information because in New York State, the laws for suing a government agency are different from the laws for suing a private company.


2. In New York State, the statute of limitations for most personal injury claims is three years. However, suing a government agency is different. In this situation, you must file a document, called a Notice of Claim, within 90 days of the accident. If you decide to go ahead with a lawsuit against the government agency, you must file the suit within one year and 90 days of the accident.

3. Even if your accident occurred on a government agency transportation vehicle, it does not necessarily mean that the government agency is responsible. If you were injured in a mass transit accident, you need to prove that the government agency was negligent or one of its employees was negligent while acting within the scope of their work duties. Negligence occurs when a person acts in a careless manner, or fails to do a specific duty, which results in someone else getting hurt or having their property damaged. For example, a government agency might be liable for injuries caused due to equipment failure, poor construction, lack of facility maintenance, poor lighting conditions, or errors caused by a mass transit operator.
