After A Crash, Get The Compensation You Deserve

People living and working in White Plains, Yonkers, Manhattan, Queens, Staten Island, the Bronx, and throughout Westchester County, Rockland County, Putnam County, and Dutchess County, rely on various modes of public transportation to get around. Though public transportation is mostly safe and reliable, mass transit accidents can be catastrophic and leave passengers, pedestrians, and other motorists seriously injured or even dead.

The skilled attorneys at The Law Offices of Jason B. Kessler provide clients with experienced representation in a wide range of personal injury cases, including mass transit accidents. We are zealous in our pursuit of determining the cause of subway, bus, taxi, ferry, and train accidents. Once the cause and fault are determined, we can take action against the negligent party or parties, whether it is the vehicle operator, owner and/or manufacturer. By discussing your accident with one of our experienced lawyers, you can determine what legal action you need to take. We can file a claim for you and negotiate with the insurance company to make sure that you receive the maximum monetary compensation possible for your physical injuries and emotional suffering.

What You Need To Know if You Were Hurt in a Mass Transit Accident

1. If you were injured in a mass transit accident, you need to determine if the party at fault was a private company or a government agency, such as the MTA, Staten Island Ferry, Bee Line Bus, or other public transportation service. This is important information because in New York State, the laws for suing a government agency are different from the laws for suing a private company.

2. In New York State, the statute of limitations for most personal injury claims is three years. However, suing a government agency is different. In this situation, you must file a document, called a Notice of Claim, within 90 days of the accident. If you decide to go ahead with a lawsuit against the government agency, you must file the suit within one year and 90 days of the accident.

3. Even if your accident occurred on a government agency transportation vehicle, it does not necessarily mean that the government agency is responsible. If you were injured in a mass transit accident, you need to prove that the government agency was negligent or one of its employees was negligent while acting within the scope of their work duties. Negligence occurs when a person acts in a careless manner, or fails to do a specific duty, which results in someone else getting hurt or having their property damaged. For example, a government agency might be liable for injuries caused due to equipment failure, poor construction, lack of facility maintenance, poor lighting conditions, or errors caused by a mass transit operator.

Mass transit accidents can vary from minor to major, occurring on many different types of transportation. We competently represent clients who have suffered injuries in the following situations:

  • Bus accidents
  • Train accidents
  • Subway accidents
  • Taxi accidents
  • Ferry accidents
  • School bus accidents
